What we do
A hacked website and the revised Data Protection Act
Switzerland's revised Federal Act on Data Protection (nDSG / revDSG) has applied since 1 September 2023. If a data security breach is likely to result in a high risk for the people concerned, the organisation responsible must report it to the Federal Data Protection and Information Commissioner (FDPIC / EDÖB) as soon as possible, and in some cases inform the people affected. If you also serve customers in the EU, the GDPR can apply as well.
Whether a website hack reaches that threshold depends on what the attacker could access. That is a technical question first: was there personal data on the site, could the malware read it, and for how long? Our written report answers those questions as far as the evidence allows, so you and your legal advisor can decide. We don't give legal advice.
